Terms of Use and Services Agreement

These Terms govern your use of the website, galleries, and services provided by Ashley Kruse Photography (“we,” “us,” or “our”) as well as all photography sessions and related services. By accessing the website, viewing galleries, or booking photography services, you agree to be bound by these Terms.

If you do not agree, please do not use our website or services.

1. Website Use

You may use our website for lawful purposes only. You agree not to use the website:

In any way that violates applicable laws or regulations
To infringe upon the rights of others
To interfere with or disrupt the operation or security of the site
To attempt unauthorized access to any portion of the site

2. Intellectual Property

All content on this website, including photographs, text, graphics, logos, branding, and design (collectively, “Content”), is owned by or licensed to Ashley Kruse Photography and protected by copyright and other intellectual property laws.

You may view content for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, publish, display, sell, or create derivative works without prior written permission.

3. Photography Services and Galleries

Client galleries may be hosted on platforms like Pixieset and may be password-protected. Access is granted only to authorized users.
You agree not to download, share, alter, or distribute images except as permitted by your agreement with Ashley Kruse Photography.
Unauthorized use of images may result in termination of access and potential legal action.

4. Booking, Payment, and Contracts

A $50 non-refundable retainer is required to reserve your session date.
The remaining balance is due prior to delivery of the final gallery.
Payment methods accepted: credit card, cash, check, Venmo, and Zelle.
Photography packages, pricing, cancellations, rescheduling, and session policies are governed by this agreement.

Acknowledgment of Terms:

By submitting payment for an invoice from Ashley Kruse Photography, you acknowledge that you have read, understood, and agreed to these Terms. Payment constitutes acceptance of all policies and is legally binding.

5. Session Policies

Scheduling: Session times and locations will be coordinated via email or text. Travel fees may apply for locations outside the standard service area.
Weather: Sessions may be rescheduled due to inclement weather at the Photographer’s discretion.
Image Delivery: Final edited images are typically delivered within 1–3 weeks of the session.
Artistic Style: By booking, you acknowledge familiarity with the Photographer’s style and grant creative discretion in editing and image selection.
Prohibited Alterations: Clients may not alter images in ways that misrepresent the Photographer’s work (e.g., filters, color changes, graphics).
Client Responsibility: Clients are responsible for supervising minors and preventing damage to props or equipment.

6. Session Types and Additional Policies

Senior Photography Sessions:
Clients must provide yearbook submission requirements and deadlines in advance. Rush fees may apply for expedited processing.
Session times are approximated and finalized via email or text.
Package options and pricing will be discussed at booking.
All other standard session policies (weather, image delivery, artistic style, prohibited alterations, liability, cancellation/rescheduling) apply.
Other Session Types (Family, Couples, Headshots, etc.):
Standard session policies apply. Specific add-ons or location fees will be communicated at booking.

7. Intellectual Property and Image Use

The Photographer retains copyright ownership of all images.
Clients receive personal use rights for printing and sharing.
Unless otherwise requested in writing, the Photographer may use images for portfolio, website, and social media promotion.

8. Liability

The Photographer is not liable for injuries, accidents, or property damage during sessions.
In the unlikely event of technical failure or image loss, liability is limited to rescheduling or refunding the session, excluding non-refundable retainers.
The Photographer is not responsible for cancellations due to events beyond control, including illness, natural disasters, or government restrictions.

9. Cancellation and Rescheduling

Retainers are non-refundable, but may be applied to a new date if agreed upon by both parties.
24 hours’ written notice is required to cancel or reschedule.
If the Photographer must cancel or reschedule, alternative dates will be offered.
Both parties are expected to communicate promptly and respectfully regarding changes.

10. Third-Party Services

Our site and galleries may be hosted on third-party platforms such as Pixieset.
We are not responsible for the content, policies, or practices of these third-party services. Use of these platforms is subject to their respective terms and privacy policies.

11. Disclaimer and Limitation of Liability

The website and services are provided “as is” without warranties of any kind.
Ashley Kruse Photography is not liable for any direct, indirect, incidental, or consequential damages arising from use of the site or services.
You agree to indemnify and hold harmless Ashley Kruse Photography from claims, damages, losses, liabilities, or expenses arising from your misuse of the site or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate access to the website or services at any time for conduct that violates these Terms or is otherwise harmful.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to update these Terms from time to time. Changes will be posted with a new effective date. Continued use of the website or services constitutes acceptance of the revised Terms.
